Terms of Service

Important notice
Budgi is a financial information tool only. Nothing in this Service constitutes financial advice, investment advice, tax advice, or any other form of regulated financial service. Always consult a licensed financial adviser before making significant financial decisions.
1. Agreement to Terms
These Terms of Service (“Terms”) govern your access to and use of the Budgi application and website at budgi.com.au (collectively, the “Service”) operated by Budgi Pty Ltd (ABN to be confirmed) (“Budgi”, “we”, “us”).
By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy (available at budgi.com.au/privacy). If you do not agree, do not use the Service.
These Terms are governed by the laws of New South Wales, Australia. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales.
2. Eligibility
To use the Service you must:
- Be at least 18 years of age
- Be an individual (not a corporation or other legal entity, unless expressly agreed)
- Be an Australian resident with an Australian bank account (for Open Banking features)
- Have the legal capacity to enter into a binding contract
- Not be prohibited from using the Service under applicable law
3. Your Account
3.1 Registration
You must register with a valid email address and create a secure password. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
3.2 Accuracy
You agree to provide accurate, current, and complete information during registration and to update it as necessary. We may suspend or terminate accounts with inaccurate information.
3.3 Security
Notify us immediately at support@budgi.com.au if you suspect unauthorised access to your account. We are not liable for any loss resulting from your failure to maintain the security of your credentials.
3.4 One account per person
Each individual may maintain one account. Household sharing is managed through the in-app household feature — not by sharing login credentials.
4. The Service
4.1 What Budgi provides
Budgi provides personal budgeting and financial tracking tools, including:
- Transaction tracking and categorisation (manual, CSV import, or Open Banking)
- Budget creation, monitoring, and rollover management
- Savings goal tracking and auto-allocation
- Debt tracking and payoff strategy modelling
- Net worth tracking
- Sinking fund planning
- AI-powered spending insights and financial coaching
- Weekly check-in and habit-building tools
- Scenario planning and what-if modelling
- Financial calculators (tax, HECS, super)
- Data export
4.2 Not financial advice
The Service, including all AI-generated insights, coaching messages, debt payoff projections, scenario models, and calculator outputs, is provided for informational and educational purposes only. It does not constitute:
- Financial product advice within the meaning of the Corporations Act 2001 (Cth)
- Credit advice or credit assistance within the meaning of the National Consumer Credit Protection Act 2009 (Cth)
- Tax advice
- Legal advice
Budgi does not hold an Australian Financial Services Licence (AFSL) or an Australian Credit Licence (ACL). Do not make financial decisions based solely on information provided by the Service.
4.3 Open Banking (CDR)
If you connect a bank account via our CDR integration, you expressly consent to:
- Budgi and its CDR intermediary (Basiq) accessing your banking data on your behalf
- Storage and processing of that data to provide the Service
- The CDR Data Holder (your bank) sharing data with accredited parties
You can revoke CDR consent at any time via Settings → Connections. Revoking consent will disconnect future data syncing but will not delete historical transaction data already imported, unless you also request account deletion.
4.4 AI features
The AI coaching and categorisation features are powered by Claude (Anthropic). AI outputs are generated algorithmically and may contain errors, omissions, or suggestions that are not suitable for your individual circumstances. You are solely responsible for any decisions you make based on AI-generated content.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any Australian or applicable law
- Attempt to gain unauthorised access to any part of the Service or other users’ data
- Upload, transmit, or distribute malicious code, viruses, or harmful content
- Reverse engineer, decompile, or attempt to extract source code from the Service
- Scrape, crawl, or systematically extract data from the Service without express permission
- Circumvent rate limits or access controls
- Impersonate another person or entity
- Use the Service to commit fraud or provide false financial information to third parties
- Resell, sublicense, or commercialise the Service without our written consent
- Enter financial data belonging to someone else without their explicit consent
Violation of these terms may result in immediate account suspension or termination without notice.
6. Fees and Payment
6.1 Free tier
The core features of Budgi are currently free of charge. We reserve the right to introduce paid tiers in the future. Any such changes will be communicated with at least 30 days’ notice.
6.2 Future paid features
If premium tiers are introduced:
- Fees will be displayed clearly before purchase
- Subscriptions will auto-renew unless cancelled before the renewal date
- Australian Consumer Law rights, including rights to a refund for major failures, apply
- You can cancel at any time; access continues until the end of the billing period
7. Intellectual Property
7.1 Our intellectual property
The Service, including its design, code, features, AI models, brand assets, and content created by Budgi, is owned by Budgi Pty Ltd and protected by Australian copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for your personal, non-commercial purposes.
7.2 Your data
You retain ownership of all personal and financial data you enter into the Service. By using the Service, you grant Budgi a limited licence to process your data solely for the purpose of providing the Service, as described in our Privacy Policy. We do not claim ownership of your financial data.
7.3 Feedback
If you submit feedback, suggestions, or ideas about the Service, you grant us a royalty-free, perpetual licence to use that feedback to improve the Service without any obligation to compensate you.
8. Third-Party Services
The Service integrates with third-party providers including Basiq (Open Banking), Anthropic (AI), Supabase (database), and Vercel (hosting). Your use of these integrations is also subject to those providers’ terms and policies. We are not responsible for the actions, content, or privacy practices of third-party services.
Links to third-party websites within the Service are provided for convenience only. We do not endorse and are not responsible for the content of external sites.
9. Disclaimers and Limitation of Liability
9.1 Service provided “as is”
To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
9.2 No guarantee of accuracy
While we strive for accuracy, Budgi does not warrant that:
- Transaction categorisation will be accurate
- Balance calculations will exactly match your bank statements
- AI coaching insights will be suitable for your circumstances
- Financial projections or scenario models will reflect actual future outcomes
- The Service will be uninterrupted, error-free, or available at any particular time
9.3 Limitation of liability
To the maximum extent permitted by the Australian Consumer Law, Budgi’s total liability to you for any claim arising out of or in connection with the Service (whether in contract, tort, or otherwise) is limited to the greater of: (a) the total fees you have paid to Budgi in the 12 months preceding the claim, or (b) AUD $100.
We are not liable for: loss of profits, loss of data, financial loss, indirect or consequential loss, or any loss arising from your reliance on AI-generated content or financial projections.
9.4 Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law that cannot lawfully be excluded or limited. Where the Australian Consumer Law applies, our liability is limited to the extent permitted by that law, including (where applicable) re-supplying the service or refunding the cost of having the service re-supplied.
10. Indemnification
You agree to indemnify, defend, and hold harmless Budgi, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or relating to:
- Your violation of these Terms
- Your use of the Service in a manner not authorised by these Terms
- Your violation of any applicable law or third-party rights
- Any financial decisions you make based on information provided by the Service
11. Termination
11.1 By you
You may close your account at any time via Settings → Account → Delete Account, or by emailing support@budgi.com.au. Upon deletion, your data will be permanently removed within 30 days (subject to legal retention requirements).
11.2 By us
We may suspend or terminate your account immediately and without notice if you:
- Breach any provision of these Terms
- Engage in fraudulent or illegal activity
- Create risk or legal exposure for Budgi or other users
We may also terminate the Service entirely with 30 days’ notice. In the event of service termination, we will provide a data export of your information.
11.3 Effect of termination
Upon termination, your right to use the Service immediately ceases. Sections 7, 9, 10, and 12 of these Terms survive termination.
12. Dispute Resolution
If you have a complaint or dispute:
- Contact us first — email support@budgi.com.au. We aim to resolve all complaints within 10 business days.
- Mediation — if unresolved, either party may request mediation through the Resolution Institute or a mutually agreed mediator.
- Courts — if mediation fails, disputes will be resolved in the courts of New South Wales, Australia.
For CDR-related complaints, you may also contact the Australian Financial Complaints Authority (AFCA) at afca.org.au or on 1800 931 678.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified to you by email at least 14 days before they take effect. The current version is always available at budgi.com.au/terms. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
If you do not accept the updated Terms, you must stop using the Service and close your account before the changes take effect.
14. General
- Entire agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Budgi regarding the Service and supersede all prior agreements.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
- No waiver: Failure to enforce any provision of these Terms does not constitute a waiver of that provision.
- Assignment: You may not assign your rights under these Terms without our written consent. We may assign our rights in connection with a merger, acquisition, or sale of assets.
- Governing law: These Terms are governed by the laws of New South Wales, Australia.
